After being pulled over by a law officer on the basis of a potential DUI, the driver must submit to either a breath, blood or urine test. These tests are intended to reveal the blood alcohol content (BAC) level in the blood stream of the driver. If their BAC level is over .08 percent, they are considered to be intoxicated and will most likely be arrested. In the case that they are under the legal drinking age of 21, their percentage need only to be at .02 or greater for them to be considered under the influence. Unfortunately, these tests are not entirely accurate 100% of the time.

Possible Errors That Can Occur

While blood tests are administered by medical professionals and can appear very straight forward, there are a variety of problems that can arise, causing an incorrect reading. It is important to look at the possibility for error, as the BAC level can determine whether or not you face serious penalties for a DUI. For instance, if a cotton swab with rubbing alcohol was used to clean off the surface of the skin prior to taking the sample, the results could be tainted. The rubbing alcohol could alter the test results just enough to cause an innocent individual to be seen as guilty.

Additionally, if the driver has certain health issues such as diabetes, their blood stream can be high in ketones which can provide an inaccurate reading. Even medicines such as cough syrup or some herbal supplements have alcohol in them, which can cause inaccurate readings. The medical technicians can also be at fault as the glass vile that the blood is drawn into must have the perfect amount of preservatives and anti-coagulant or else it will ferment the blood sample. Lab machines can also be a source of error and should not be taken as the only evidence for a DUI conviction.
