Drunk Driving FAQs

I've been arrested for DUI in Pittsburgh, what now?
Those who refuse the breath test have a strict time limit for contesting a 12-month suspension of their driving rights. A criminal case will be conducted separately. Possible consequences of conviction include jail time, license suspension, ignition interlock devices, alcohol treatment or assessment, probation, fines and court costs.

Can I get driving privileges for work?
First-time offenders may be eligible for an Occupational Limited License (OLL) after 60 days. Those facing an 18-month suspension may not be eligible for 12 months.

What happens at the first hearing?
At arraignment or preliminary hearing, you will get formal notice of the charges. You should seek the representation of a Pittsburgh DUI defense attorney.

Is DUI a misdemeanor or felony?
Under Pennsylvania law, it can be either. Typically it's a misdemeanor unless serious injury or other aggravating circumstances exist.

Will I go to jail?
Maybe. Jail time is not typical for first-time offenders but is possible for a variety of reasons. Repeat offenders or those with significant extenuating circumstances may face jail time.

How much will it cost?
Cases vary. Nationwide estimates show the total cost of a DUI conviction can approach $20,000, counting lost work, fines, fees, skyrocketing insurance premiums and other costs. Hiring an experienced attorney and fighting the charges can actually save you money in the long run.

What if I drive on a suspended license?
This is one of the most common ways that a defendant makes a bad situation worse. Driving on a suspended license is a new crime and the penalties include jail time.

Should I accept a plea bargain?
We don't recommend taking any deals without speaking to an experienced law firm. In some cases, an experienced Pittsburgh drunk driving defense lawyer can seek a reduction in charges or negotiate a plea as the best solution for your case. Speak to an attorney.

What is the Accelerated Rehabilitative Disposition (ARD)?
Pennsylvania's Accelerated Rehabilitative Disposition is an alternative sentencing measure available to first-time offenders who meet certain criteria.

Will a conviction end up on my driving record?
Yes.

Will an ignition interlock be required?
Conviction for a second or subsequent DUI will likely result in installation of an ignition interlock device for at least one year.
