Boating DUI Lawyer in Pittsburgh

Charges of boating under the influence in Pittsburgh and the surrounding area are on the rise. And those convicted face serious fines and penalties and may lose their boating privileges for 12 months. Those involved in a fatal boating accident while under the influence face fines of up to $15,000 and three to seven years in prison. These charges apply to boats as well as other watercraft, including waverunners. Those with a blood-alcohol level as low as .05 may face charges in court. Charges may be brought by a waterway officer, even if the violation occurred outside his presence. Such cases can arise when a patient is being treated for injuries at a local hospital.

Pennsylvania Laws: Boating & Alcohol

Rules and regulations from the Pennsylvania Fish & Boat Commission:

  • Alcohol is prohibited on land and water in all state parks and along many other waterways. In some places it is legal to drink and boat. Although public drunkenness and underage drinking charges may apply.
  • Under the influence charges may still apply.
  • Waterway Conservation Officers may request that those suspected of being under the influence submit to a preliminary breath test.
  • Those who refuse a breath test upon arrest face a 12-month suspension of their boating privileges.

A charge of boating under the influence in Pennsylvania can be just as serious as a drunk driving charge.
